4. Payment Terms

• Project Deposits: A 50% deposit is required to begin work on most projects
• Payment Schedule: Remaining balance is due upon project completion
• Recurring Services: Monthly services are billed in advance
• Late Payments: Late payments may result in service suspension
• Refunds: Refund policies vary by service type and are outlined in individual agreements

5. Intellectual Property

Client Ownership: Upon full payment, clients own the final deliverables created for their project.

Our Rights: We retain the right to display work in our portfolio and use it for marketing purposes, unless otherwise agreed in writing.

Third-Party Assets: Clients are responsible for obtaining rights to any third-party assets used in their projects.

6. Project Timeline and Deliverables

Timeline: Project timelines are estimates and may vary based on project complexity and client feedback cycles.

Deliverables: We will provide all agreed-upon deliverables as outlined in the project proposal.

Revisions: We include a reasonable number of revisions as specified in each project agreement.

7. Limitation of Liability

MyWebsite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

Our total liability to you for any claims arising from the use of our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

8. Warranty and Support

Warranty: We provide a 30-day warranty on all development work, during which we will fix any bugs or issues at no additional cost.

Support: Ongoing support and maintenance services are available under separate agreements.

Third-Party Services: We are not responsible for issues arising from third-party services, hosting, or platforms.

9. Termination

Either party may terminate this agreement with written notice. Upon termination:

• All outstanding payments become immediately due
• We will deliver all completed work
• Client retains ownership of delivered work
• We retain the right to use work in our portfolio

10. Confidentiality

We agree to keep confidential any proprietary information shared by clients during the course of our work together. This includes business plans, trade secrets, and other sensitive information.

This confidentiality obligation survives the termination of our agreement.

11. Dispute Resolution

In the event of a dispute, both parties agree to:

1. First attempt to resolve the dispute through direct communication
2. If unsuccessful, engage in mediation with a neutral third party
3. As a last resort, pursue legal action in the appropriate jurisdiction

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MyWebsite operates, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on our website and updating the "Last updated" date.

Continued use of our services after changes become effective constitutes acceptance of the new terms.
